F-1 spouse status married GC holder Help!

Hi All,

Please advise in following: My wife is currently in US on F-1 visa and taking classes. We are married (i am a GC holder) and still have to wait till 2009 to apply for citizenship.

My question is if the Wife doesn't have intend to leave the country shall we maintain the status on F-1? We are already submitted I-130 forms, etc.

What will be consequences if she would be out the status at the time of my application for US citizenship. Any problems with that?

The other problem is that it would be very expensive for us to maintain F-1 status.... Any other options or cheaper way to maintain F-1 status?

I think maintaining valid non-immigrant status is the best thing to do.

The overstay will be forgiven if you file the I-485 after becoming a citizen, but the problem is if you a) do not become a citizen right away; or b) if she gets deported by ICE in the interim.
