Hi all,
I have a very important question for my friend who is out of status on her F1-visa. She had been out of status for more than a year. What are the consequences? anybody has experience so plz share with us. she was expecting a baby and had little complications during pregnancy( but could'nt get a doctors letter for tht), she has the baby now he is born in US. Will she have any advantage with the baby as a US citizen? I mean does it show any reason for being out of status? can she leave the country(say canada) and come back with the stamp? how safe is it now at this stage(more than a year). she is so worried. Plz help us with ur valuable replies.
Thankyou so much...

You may want to ask the same question in this forum
http://britishexpats.com/forum/

This is an excellent site. scroll down and there are sub-forums: US immigration, US visas.

You may also do a search once in the site to see if the question has been already asked.

Hope you will get answers either here or there.

The only advantage of having a US born baby is that someday when her son is 21 years old he can file a petition on her behalf to become legal but that may even change someday. I was watching the news the other day and there was a discussion about the US Citizenship birth right, basically, some politicians want to change the constitution that a child born in the US by an illegal mother should not be a citizen by birth. They said that 1 in 10 children born in the US has an illegal mother and they want to put a stop to that. I don't know if that will pass though, I highly doubt it. The best option that your friend has right now is to get married. Who is the father of her child? Is there any way that they can get married? It would end all of her worries and frustrations. If it is not possible for her right now to get married, it will be really hard for her to raise her child while she is illegal. Is she working? Who is supporting her and her son right now???
