I am currrently on opt which expires on May 12, 2007. I want to transfer to H4 as I am preparing for my board exams. My wife's employers says that we can apply for H4 only when she gets her paystub. Since her H-1 approval (last 2 months), she has not yet got her project so no paystub. Her employer says that I can file for H4 anytime before May 2007.
Is it true that I can wait till May 2007 to file for H4?
Will I be on status if I file sometime before May 12, 2007 and case is pending? Or do I have to get H4 status before May 12, 2007?
can you tell me what will be the best option for me in this case.

you need to FILE change of status to H4 before May 2007. Pending petition will give you authorized stay.
