EXTREMELY URGENT -- Please advise anyone....

My employer is getting hesitant in applying 485. My pending I-140 has PD in 2004 whereas my approved I-140 has PD in 2005:

1. Please let me know if I can change employer, apply for a new GC thru them but still keep my previous PD? If so, how?

2. Can I apply for GC as soon as I apply for new H-1B?

3. Do I need anything from this employer before I leave (like copy of labor, I-140 etc)?

Please advise.....
 
Yep, I wonder - why your employer filed labor and I140?......Sure, is a funny employer or more like WANTS TO CONTINUE YOUR EXPLOITATION FOR EVER....HEE HEE! I WOULD SAY, if he is hesitating to file I485...tell him, you are hesitating to work and feel like staying at home! Hee Hee!

1. Yep, if you can get an employer to give you approved labor for substitution....then may be you could apply I140/I485 through new employer. If you are thinking of applying from scratch - starting in PERM....not sure...if Dates would stay current until then

2. Yep, you can PERM may take 2-8 months...not sure if Job Ads would take addition 60 days or more

3. Yep, I-140 approval notice...preferably, if want to port your PD...It may help...BUT LOT OF EMPLOYERS DO NOT GIVE IT....

thx for replying....yea, i dont think he will give me I-40 approval notice if I leave him......I wish i can apply 485 myself or some other attorney, but the problem is I'll need a employement letter.....any work arounds for this? or any way that i can lure him in giving me this employment letter?

btw, as always, this is a desi consulting company.....

May be the desi comp wants to substitute Ur labor for someone else.

Check if you can do this with Ur attorney:

Apply for 485 without employment letter... the USCIS will start the process as soon as they get the fees and assign U a A#..

Pray that date should retrogress again ..

If 6 months gets past apply for AC-21.

and now if there is a RFE ... regarding the employment .. U have a new employer.
 
When I applied for 485 concurrently and forgot to send in the employment letter.
Then 2 year later in year 2006 they send me an RFE on 485 .. asking for letter from employer stating that the terms and conditions of the labor is still valid ... I am still with the same employer since I started my process .. so that was an easy RFE..

But after RFE .. no news from them .. still waiting ..
