Dear Sir or Madam,

I am a student enrolled in the MBA program. I came to this country in Jan'2000(Spring 2000 Semester) for MS Computer Science. I've graduated in Dec'2001 and my OPT started in Jan 2002. I've exhausted one full year of OPT time. In Spring 2003 I've enrolled myself into the MBA Program and now I'll be graduating in May 2005. I was told by my school authorities that I am not eligible for another year of OPT after MBA as I've already used up 1 yr during 2002. I know that the H1B cap doesnt start until October 1, 2005. I was just wondering if my stay is legal or not during the period between May 2005 and October 2005 if I could find an employer who is willing to file for H1B in April 2005. Please advise me....I am really confused.

What is the status of the new 20,000 H1B's start date for sending applications.

Thanks,

Krishna

Krishna,

I think there are 2 scenarios - One, if the H1 Visa Reform Act goes into effect before you graduate (May 2005), you can apply under that quota, go through premium processing and get your H1 in a couple of weeks
Two, if that Act does not pass, unfortunately you will be out of status either right after graduation or after the grace period, if any (pl check with an attorney on any 30 or 60 day grace period you may have - I'm not sure).

Hi
As far as I know according to the new F1 policies a person can get 2 OPT's provided the second program is of higher educational level than the first. You might want to check on this.
