Extn. after 6 years.

Hi Friends,

1. I came to USA in Dec 1999, so will be completing my 6 years in Dec 2005.
2. Went for a month in 2001 to India and came back.
3. Labor applied more than a year back, state cleared and went to Federal.
4 Recently 1 month back, same employer applied in PERM process. (In this process, he withdrew the previous application in the regular process).
5. My current H1-B shows an expiry date of Oct '06.

My questions are:
1. Do I have to apply now before Dec for the extn or can I wait until Oct '06?
2. What are my possibilities of getting extn, if I have to apply now?

1. Do I have to apply now before Dec for the extn or can I wait until Oct '06? Since INS overlooked the days, you must apply now and get it fixed.
2. What are my possibilities of getting extn, if I have to apply now? It is not clear, whether you transfered the BEC LC to PERM or made a new PERM. If you would have made new PERM and withdrew your year old LC means you have committed a blunder, you will regret it.

Any how sooner is better. What evidence are you going to give to extn 7th year extn if you withdrew your old petition.
