Hi,

My parents recieved 6 month visa stamp in passport, and a
6 month I-94 stamp upon entry. The 6 month is expiring onSept 5th, 2003.

- Can they file for I-94 extension beyond 6 months, even though
the visa itself was for total 6 months?

- We are asking for extension because my niece is undergoing
major surgery for which we need help in post operative care.
It is in major hospital and the hospital is willing to write a strong
letter of support for visa extension.

- By when does INS need to recieve extension request form?

- What are the forms, fees, and supporting documents to be submitted?

This is important issue and very serious medical condition for
their grand child. Appreciate your collective guidance

It is in major hospital and the hospital is willing to write a strong
letter of support for visa extension. Seems like a good reason.

Before expiration of current I-94, Sept 5 in your case.

- What are the forms, fees, and supporting documents to be submitted? Form I-539. Check www.immigration.gov for form and fees.

They can apply for the extension and may get it. But the only caveat is when they try for another visit in the neat future if they don't already have a 10 yr multiple. This may reject the visa saying that you tried to overstay your visit or tried by applying for the extension. I guess they only look at the intent eventhough one got the permission from the BCIS.I am not saying that this will always the case but it happened to my friends parents.

You never know with the BCIS ... wish you good luck.
