I am not quite aware about that re-employment process and whether you have to be re-hired or laid-off. When I was in that situation when my J1 expired I was supposed to be re-hired, put a formal employment application and run through the whole hiring process as a new applicant. Since I switched employers after getting the EAD, I never did that, and can't really tell you about your case. Get to a couple of lawyers those question (not only the advice of your laweyr though, it seems somehow that he's misleading you in some aspects)
But you shouldn't receive any paychecks, cos this is the actual proof that you work. If you receive paychecks your income will be still reported as well as all applicable taxes. So just a simple check up on your Social Security will show "working through that period". Any goverment authority or a company can access and check through your soicial security number to view the periods you worked in the USA, income, taxes etc....
 
Spoke with one Attorney. he said, It may not create problem but for safe side I should apply for H1B.

I would talk to another attorney today.
 
Hi All,

I was working on gathering the docs for H1B extension with another attorney.

Luckily my husband got his EAD yesterday evening. We were surprised that we got the EAD in just 15 days. Our documents was sent on Nov 14th and it was received on Nov 17th.

Then I checked for my EAD in immigration website. It says "EAD has been approved on Dec 3rd and it is mailed to you." Hope fully I will get my EAd in a day or two.

Also, just now our attorney called and said he got our Travel Documents. It's very fast.

Hope this will help somebody in my position.
