Extension approved after we left

Hi we stayed 6 months in USA under a B2 visa (Jan to July) and we applied for an extension, since we had a separate project to do.
Since we didn't get an answer in time, we left before our i94 expired (not worth risking an overstay).
a month later (Sept) we came back to do a project in USA with our company in europe (3month period Sept-Nov) and we were given a new i94 for those 3 months.
But now we just received the original 6 month extension till Jan 2011 for the old i94.

In principle if the project goes well we would not need to stay any longer than the actual i94 (expiry Nov), but if we need to..can we stay longer using the visa extension i94 (Expiry Jan 2011)?

thanks.

Why are you working in the US on B2 visa? This is illegal. Apply for the proper visa type. B1 may be appropriate but that should be determined by an attorney since you obviously are too unfamiliar with US immigration rules if you think you can work on B2.

Travel during processing of an application voids the application so the extended I-94 is no longer valid even though the extension was approved.

We are working in a project for an European customer with our European company, but the works are carried over in US soil.
This has been checked out already in the POE, and is perfectly legal to bring an engineer in a B1 VISA to do those works .we hold a B1/B2 visa and we were granted the i94 under the B1 category for this last visit.
However we stayed the first 6 months on the B2 category since it was a personal tourist visit.

Travel during processing of an application voids the application so the extended I-94 is no longer valid even though the extension was approved.

Ok understood, thank you very much.

It appears that you understand the difference in the requirements and are properly using the different visas. Please be very specific in the future when posting about your work activities to specify that you are actually on B1 to avoid confusion. There is already a great deal of confusion for many about the ability to work on B2 status. Reading a post about someone working on B2 leads them to believe that such work activities are proper. Thanks!

You can not use an extension for an I-94 that is already used up. You already left the country for the I-94 you got an extension for... the only I-94 that has any validity is the 3 month one you got at the airport.
