Expiring N-400 Form

Hello everyone,
I noticed that the current form on the USCIS website is expiring on 10-31-08 (Friday). I am getting ready to file that following Monday on 11-3-08. Do you think they will be posting a new version with a valid expiration date that same day or can I go ahead and file with the current version if I don't see anything posted from them.

Thanks,

Just check with the USCIS a day before you want to fill out the N-400 form. If the form is available on USCIS official website, I would use the latest version otherwise there is no need to wait for the latest & updated version, just go ahead & use whats out there & you will be fine.
I remember I had to file I-765 (EAD card) for my wife back in June and I had no choice but to use an expired form as there wasn't a new version available on USCIS website. I also called USCIS cust service to double check with them and they said I can go ahead & use the previous version.

I would wait a week or so for them to post the new form.

Any time USCIS invalidates one version of the form (not just citizenship), with a final grace period during which they'll continue to accept the old version, some of the clerks will wrongly reject the applications done with the old version. Of course you can reapply, but you can't get back those weeks that were wasted.

For example, this is from Oh Law's web site about the I-765 form.
Current form shows that it expired on August 31, 2008. There have been some reports that relying on this information, some confused USCIS mail room staff rejected filing of I-765 with the expiration date of 08/31/2008. However, the reality is that this form has been extended until 09/30/2011 by the OMB and remains still valid.

If you wait a bit and they still don't post a new version of the form, or they extend the existing version for some more time, then you don't really have a choice, you just have to go ahead and use what is available. But if they are going to publish a new form in the near future, it would be safer to use it even if the old one remains valid for the next couple of months.

sbenni1,

I wouldn't waste another day. If I am ready to file tomorrow and the latest form is not available out there, it wouldn't make any sense just to wait another week and hope that USCIS would come out with the latest form.....huh. We all know that when we file stuff with immigration, every day matters, we all want to get it done & overwith. In short, I would not wait another day & file immediately with the previous version.

Good luck

This is not green card or H1B processing where priority dates and quotas can cause 1 or 2 days to seriously matter. Rushing to send the form before the new version is out, in an effort to save 2 days, could cause a loss of 2 months. Ultimately it is the OP's decision, as he/she is the one who will bear the consequences good or bad.

USCIS web site says that N-400 with edition dates of 10/15/07, 07/30/07, 11/01/06, 05/31/01 can be used. No other editions accepted. Draw you own conclusions.

Thank you folks for your answers

nkm-oct23 - If you open the N-400 file, you will see in the upper right-hand corner an expiration date of 10-31-08.

Much appreciated,

I have no idea what you are talking about. Waiting for the new version does not make any sense to me. You file when you want to file. You don't know when the new forms will be out. Why would anybody wait for a week and hope to get a new version to be out.....huh. If the USCIS web page tells you not to file coz the new form is not out & gives you a new date, ok I can understand & see your point but just to wait without knowing and hope for a new version to come out soon.....what nonsense. Wake up man.

In short, the sooner you apply the sooner you get your receipts (NOA's in the mail) and the sooner you get your biometrics appointment and the sooner your case gets in the que for I-131, I-765 and I-485 applications to be processed. It doesn't take a rocket scientist to understand this simple procedure.
