Expiring Green Card! Can I get a temporary document??

Hi all,

I guess this is not the first of these posts you have read but after reading some of them I still wanted to check what would be the best and fastest procedure.

Although I had changed my address in the USCIS website my notice to renew my green card was sent to my old residence. This was the first of a series of delays the next ones being able to get all of the paperwork needed to file the request to remove the conditions on my green card.

The card expires September 17th.
I sent my papers on August 27th and have been delivered to CA office on the 29th.

All the info on processing times I could find says it takes and avg. of 6 months. When I first was waiting for my GC I was given a temporary work permit. Is there any way I can get such thing now? I wouldn't want to not be able to work or travel for those 6 months!!

Did you change your address after submitting the renewal application? Are you renewing a 10-year green card, or removing conditions on a 2-year green card?

Did you receive a receipt notice for your renewal application?

If you already showed your green card for the I-9 paperwork with your employer, your existing employer is not supposed to ask you about it again when it expires. If you have a Social Security card without the employment restriction wording, you can show that for new employment (combined with your driver's license or state ID) without having to show the GC.
 
Am I still eligible to work?

I am removing conditions on a 2 year card and changed my address more than a year ago when I actually changed residences. All of my documents I submitted with form I-751 have the new address plus I have attached a list I prior residences since we got married.


I haven't gotten a receipt yet. How long does this take? Am I eligible to work while this is being processed?

If you already showed your green card for the I-9 paperwork with your employer, your existing employer is not supposed to ask you about it again when it expires. The problem with this is that I am a freelancer so I fill up w4s quite often. My SSN card doesn't have any of that wording but, wouldn't I and my employer be braking the law if he/she hires me although the work permit my GC grants me has expired?? Also I don't have my DL nor state ID. I am taking my behind the wheel exam this Friday but the License will take 30 or 60 days until it reaches me. My wife just renewed hers more than a month ago. In fact I submitted only copies of our temp Driving permits as our proof of residing in the same house. Waiting at least for hers was driving me nuts and added time to the filing process.

I also realized I forgot to add the 2 affidavits of people who know us stating that our marriage is a lawful one. I foresee a long and tedious process.

The I-751 receipt contains a notation that extends your green card for a year. You applied last week; expect the receipt to arrive next week or 2 weeks from now. If you need to travel before the new green card arrives, show the extension notice along with the expired card.

If you are still a permanent resident, which you would be if you submitted the I-751 before the expiration of your 2 year card and are awaiting the decision, it is legal for you to work and for the employer to accept your unrestricted SS card + DL/state ID as evidence of eligibility to work.

Don't worry about not sending the affidavits. Those affidavits are for people whose other evidence is weak.
 
Right after my second posting I went to the mailbox and voila! there was my receipt.

So I'll keep my expired GC and this receipt to show when I travel or if I am asked by an employer and wait for word from USCIS.

Thanks so much for your quick responses. All I have left to wish is that I pass my behind the wheel exam on friday to get my Driver's License :rolleyes:
