I am not a Canadian citizen but spouse of a Canadian Citizen and have TD visa which is expiring in April 2008 but the I-94, I was issued when I landed in US has an expiration date of September 2008. Can I stay in the country till the expiration of I-94 or I have to leave US on the expiration of my TD Visa?

You can stay until I-94 expiry, and can even renew your status from within US without renewing your Visa. it is only if you leave US that you may need to renew your visa at consulate.

valid I-94 but expired visa

within how many days do we have to get our status renewd??how long does it take to get this done??

It takes 4-6 months, but your status extensions get a 240 day grace period, after expiry, but you need to submit the paperwork (i-539) BEFORE it expires.

Then, should you ever leave US, you would also need to get a visa (which is separate from your I-94, or status) appointment before returning.
