Expired I94 H1-B still valid

My current I94 expired on 11/02 since my passport expired I traveled outside US and came back in July/02. I got my new passport and I completed my special registration in Jan-03 without any issue and immigration officials didn't point out anything. I was not aware of this till someone pointed this out and said that you could be in trouble due to fact that I94 is expired my H1-B is still current till 1/04 and is under process for renewal.

So do you have a H1 valid till 01/04 but do not have a I94 matching this?
Did you change employer or apply for extension beyond 1/04 with the same employer?

The extension for H1 is under process, the employer is same. I think the I94 was stamped till validation of passport although the H1 is still valid.

You should have gotten the new I94 as soon as you got the new passport or around 11/02. I94 determines your validity here in USA. You might be in trouble.
You can get a new I94 based on the h1 visa now , but with the h1 extension pending you have really messed it up.
Consult a lawyer- or wait for BCIS to give a decision on the pending h1. if they approve with a new I94 then you are covered. Otherwise if they give you a H1 without I94, you need to travel out of US and get a new I94 ASAP.
