Dear ImmigrationPortal.com members,
I had been on H1B before I applied for my I-485. My H1B visa has expired. However, I have an EAD, and Advance Parole documents with me, and my I-485 is still pending. My I-94 that has been issued based on my H1B has expired.
I am planning to visit India, and have following questions
1. Do I have to turn in the I-94 when I leave the USA, Even though it has expired?
2. Does it create a problem when I re-enter the USA on Advance Parole for having left the country with an expired I-94. I do understand that I am in a "Pending AOS (I-485) status", However, I would like your expert opinion.
3. I plan to transit thru Paris, and I understand that a Transit Visa is not required for an Advance Parolee, Is that true?
4. I am planning to carry my un-expired Advance Parole, and I-485 receipt with me, would that be sufficient?
I really appreciate it if you could help me in this regard.
Thank you.
