Expired/expiring passport and AOS interview

I have my AOS interview Aug 13th but I just realized my passport is going to expire Aug 27th. There is no way I can get a normal passport in time. I can get an emergency passport but the embassy is not sure that USCIS will stamp it. Will they stamp the expiring passport if I am approved??? or even the emergency one?
I really hope to be approved (no name check pending) because I am supposed to begin a job the day of the interview. They were going to apply for a H1B for me if I didn't have the interview but I would still need a passport for that.
I feel like I am up s**t creek without a paddle.

Any insight would be greatly appreciated.
 
You do not "need" a passport to receive a Green Card. Only to travel, even if you do get one later... they can stamp your expiring passport and you can travel using your I-551 stamp and your new passport.

All will be pointless once you get your Green Card, and your new passport. it is all you will need.

In order to work all you need is EAD though. You should be getting that before August so chill.

I do advice you to try to get your passport renewed if you plan on traveling outside of the US at some point.
 
I remember seeing somewhere in this forum that they wouldnt stamp a passport that is less than a year to expire. again, the post can be wrong.

Makes sense, but you most of the time they do not stamp passports. So, there is not point to this, he needs a passport to travel (AP if he does not have the GC) and his GC to work (or EAD if he is still stuck in name check).
 
It is true that he will need the passport to travel; however, by law every company is required to have new employees file form I-9 first day of the work which requires proof of employment eligibility.All the supporting documents for this form must be submited ont he first day which is the day he will have his interview. Unexpired foreign passport,with I-551 stamp is one of the documents that is sufficient to prove that he/she is eligible to work. Clearly he is not going to have his GC first day he starts working; it seems like he doesnt have his EAD. if his SSC states that it is not valid for employment. he can not work because he doesnt have sufficient proof that he has the unrestricted work authorization. that is why it is crucial he gets his passport stamped.

As I think I said before I really need my passport to be stamped if I do not have the EAD before the interview date because I am supposed to start a new job the day of the interview.
My new job was going to apply for a new H1B for me but since I have the interview on the 13th they decided it wasn't worth the money. I still wouldn't be able to apply for a H1B because I know for that your passport can't expire within the next 6 months or they won't give it to you!!!! (mute point now anyway) So if I get approved I really need the stamp in my passport so I can work.
I talked to the embassy and they are going to issue me a passport for 18 months so that hopefully will get stamped and they will also return my old one!!!!
My new employer also wants me to expedite my EAD in case I don't get approved on the 13th or am stuck in namecheck but I know there have been mixed reports here about trying to get that done!!!
 
You will need a letter from your employer if you want to try to expedite your EAD and you must do so before the interview. Good thing about getting the passport. I hope it all goes well! :cool:

I have an infopass appt for friday about the EAD expedition and I should have the letter in hand from my employer tomorrow so we will wait and see if my DO is accomodating!!!!!!
The passport thing has been worrying me so hopefully it will all be ok!!!!
 
Some offices/officers will not stamp a passport that has less than a year (or 6 months for some) of validity left. There is no hard and fast rule, just an issue of habit I guess.
