Experts Please help..Have Canadian PR..Wife on US H4 Status

Lot of troubles all at once! I got Canadian PR Status last year October 2004 (before I got married) - I landed in Canada and got back to US on my H1b last year. I have'nt been in Canada at all. The only time I was in Canada was for a day last year for Landing purposes. Now because of retrogression in US I have completely given up hope to pursue US GC anymore. I am currently on H1b and wife is on H4. We both have approved EADs/Advance paroles. I am still waiting for my I-140 approval. Now here are the queries -

1) What's the best way to get my wife Canadian PR Status ASAP? I do not have any Health Insurance Card or SIN and I do not wan't her to go back to India. What should I do if I wan't to move to Canada with my wife?

2) Is there any way I can still have my US GC Processing continue even after moving to Canada?

3) What do me & my wife need to show at the border enter into Canada via car? Can I move all my stuff using U-Haul and cross the border? Once me & my wife enter Canada would I be able to return back to US on Advance Parole (which is going to expire in the next 5 months)?

4) How can I move all my stuff as well as my car from Canada to US as my wife do not know driving? And if I get a U-Haul truck than how am I going to get my car??

To sponsor your wife you will first have to move to Canada. You can not sponsor anyone if you are not living in Canada.

Best option for you is to start preparing the application for sponsoring your wife(http://www.cic.gc.ca/english/applications/fc.html). As soon as you move to Canada send in your application. As there is no minimum income requirement you dont even have to worry about getting a job in Canada. Also ask your wife to go back to India. Believe it or not New Delhi, India is the fastest visa post in the world for sponsoring your spouse. The overall process from India will take just 2 to 4 months.

Another option is to try and get a Canadian visitor visa for your wife. Although it is very difficult in your case but if she gets it you can both move to Canada and then you can sponsor her from within Canada. But in this case the process can take more than 8 months and you will have to live in Canada throughout the process. Moreover she will not get government health insurance till she becomes a PR.


2) Is there any way I can still have my US GC Processing continue even after moving to Canada?

You should ask your lawyer.

At the border you will have to show your PR card to enter Canada. You can use U-Haul to move your stuff from US to Canada.

Did you prepare a goods to follow list when you landed in Canada as a PR in Oct 2004? Was it stamped by the customs official? You will not have to pay any duty on items you bring to Canada that have been listed on the goods to follow list stamped by the customs official.

Dont know much about returning to US.


4) How can I move all my stuff as well as my car from Canada to US as my wife do not know driving? And if I get a U-Haul truck than how am I going to get my car?

You can use the U-Haul truck for towing your vehicle as well. Visit www.uhaul.com for more details. You will also have to import your car to Canada. Please search the intenet for the procedure of importing your car.

Some provinces provide immediate health coverage, make some calls and find out even if you had spent only one day in Canada as a PR you have all the rights a citizen has except for voting and joining military services.
 
The best and sure way is to establish a residence in Canada (rental accomodation, telephone, cable, health card, drivers license etc)and eventually file a tax return declaring your global income (at the end of the year one files a tax return in the country one is a resident of).

Hi Aakash28,

You can sponsor your wife as soon as you return to Canada. You do not have to wait to get your SIN number or health insurance. But you will need to have an address in Canada and you can not leave Canada before her application is complete.

Sponsoring your parents is a totally different process and a very long one. To sponsor your parents you have to be employed and have the required minimum income. Check the Low Income Cut-off (LICO) information provided by CIC for details.

It is currently taking 26 months to approve you as a sponsor and then 31 to 41 months for New Delhi to complete the application. So the whole process can take anywhere from 57 to 67 months.
