My H1b transfer was denied by VSC in August 2001 as my company somehow did not submit documents supporting my previous exprience and employment . So company/attorney appealed to Administrative appeals office with all documents including exprience letters.
I got a new EAC number ( receipt notice) in sep 2001 but the actual H1 transfer is still pending till date even after more than 300 days have passed. It is very frustrating as I am not getting any communication from either my Company/attorney or INS as to what is happening on case and why it is stuck .
I am currently working on company for which transfer is sought .
My questions are ,
1. Can I write to Adminstrative appeals office to have some information/solution on my case if that helps.
2. My wife & Kid wants to go to india . Can they do so if transfer is pending . Will there be any problems in return while the transfer is pending.
3. Can I change a employer now and apply for new H1 transfer or a New H1 visa.
4. If my current employer terminates me can I join the old company whose stamping is still valid. I-94 expires in May 2003.
