I filed my LC with MI SESA. Due to pravailing wage rate problems, my lawyer decided that he will be asking MESA to transfer the file (forcebly)to Chicago DOL to decide on wage rate at DOL level. Also he said that, if we send in this way, MESA may note on the file saying this case will not be approvable. But DOL may very well ignore MESA and will approve based on the facts with the case.(i.e wage rate based on OES survey). Could somebody please respond whether this is a normal scenario or something abnormal? Also what are the chances for approval by DOL if the file transfered by MESA without their approval?

Remember GC is the job for the future, the wage need not be given right now may be 3 years from now after GC is approved. So ask your company to promise the wage after 3 years.

If you go by your lawyers route, chances of rejection is pretty high.
