Hello there:

See signature for detail - my company has a office in Bangalore, India and wants me to go there and hire/train some people and stay there for 6 weeks. I am not Indian citizen but I did my first BSC from Bangalore University. Long story short is it ok to go to India for 6 weeks and come back USA with AP (131)? Also I have approved H1B till 2009 but not stamped in the passport.

Thanks

There's not a problem from a US standpoint, but are you authorized to work in India?

Thanks TheRealCanadian - I do not have permission to work in India but my office opened a office in India in January'07 and we have about 500 IT programmers working there (they are all Indian). So I do not think I need a separate permission other than my H1B with the company and my 485 is pending with the USCIS since July 6th, 07. Please correct me if I am wrong.

Good day!

Unless Bangalore is now part of the United States, your H1B does not allow you to work there. You need an Indian work permit.

I will be working for same company I work here in USA and I will paid in USA.

Seems like you wouldn't be getting paid in Indian Rupees but legally speaking you are on a business trip to India and should have an employment visa or a business visa. You can get more information at Indian embassy website. The visa issuance has now been outsourced to travisaoutsourcing.com and you may get further information on documents needed to procure appropriate visa.

Your GC journey here has no relevance to work authorization outside the US.

Thanks both of you - I will talk to our CORP travel agent and they should know the procedure because a team of IT members went there several time this year.

FYI My company is fortune 50 company and we have a office in Bangalore with 750 IT staff.

Good day!

Dosen't matter, if your company is Fortune 500 or Fortune 50 company. Like H-1 is required to work in US - you would probably require a work visa to work there.

The Indian Consulate, New York, provides information on the relevant
Visas. It appears you will have to apply for an Employment Visa. There
is detailed information on the page and a Visa Application Form.

This is some of the relevant information.

“EMPLOYMENT VISA: Employment visas are initially issued for one-year
stay. A copy of the contract with the employer has to be enclosed.
Kindly note that Employment Visa is given only for jobs that require
very high level of skills and expertise. This can be extended by
Foreigners Regional Registration Office in India, if the job contract
continues. Spouses and children are granted co-terminus entry visas on
request.”

Thanks for all the information. I will talk to our travel agent.

Good day!

Your travel agent may not know all the legalities of an employment visa in another country.
You might be better off talking to your HR and immigration attorneys.
Talking to the teams that vistited earlier this year could also help you.
