If one person happend to be denied for F1 two times, business Visa one time within last couple of moths from back home (Dhaka,Bangaldesh), Can she/He apply for H4 Visa from Canada around february, 2003. Just for more information he/she is coming to Canada to start his/her study in Spring (January, 2003)semester in one Canadian University. He/she will also get married around february, 2003 in Canada with an H1B worker. H1B worker does not have H1 visa stamp as the way he/she got converted from F1 to H1. All this applications are taking place within one year.


Does one person has restrictions on number of application for VISA within one year. I called Dhaka, Bangladesh Embassy, they were unable to give me the right answer.

I am not expert, but shouldn't this questions post in h1 visa thread ?

1. he/she won't have any problem if he/she can convince interview officer that he/ she didn't married for sole purpose of getting entery in USA.

2. I don't think H1/h4 has any restriction for applying based on b1/f1 visa denial (unlike f1/ b1 visa when you can not apply more than 2/3 times in 2 years)

3. some consulate requires h1 visa stamp in passport before issuing h4 (I got email from mumbai consulate for the same inquiry, and I know for sure chennai consulate requires that)

4. it's seems to me the person is doing everything for entering USA, If I would INS office I would susspect that kind of history.
