MY Approved LC says 7 years of experience in 3 different companies. Actually I have more than 9 years of experience working in 6 different companies.

With I 140, should I enclose only those experience certificates that exactly match in LC or Can I enclose Experience certificates from companies that are not in mentioned in LC. I do not have one experience certificate from a company mentioned in the LC. Wondering I can enclose certificates from other employers

why take a chance

With the "denial preferred to RFE" policy of USCIS, you are better off sending in the relevant experience letters. Just submit letters for those experiences as mentioned in the labor form 750A/B.

If u don't have the experience letter from a employer, get one from your coworkers there on the letterhead of any company they are working with right now.

In my case, job requires 3yrs of exp on particular skillset as defined job description in LC. I have more than 6yrs of exp in diffrent areas, which was described in the LC. But when I filed I140, I sent only the letters/affidavits from the employers, where I worked on the particular skillset required by the Job. The letters that I sent only accounts for 3yrs of my exp as required by the LC. My 140 was filed in EB3 in Nov 03. And it as approved in March 04 after an RFE. Make sure that, you have all the W-2s for the years, which is mentioned in the exp letters that you are going to send. Because that is what they asked me for.

Finally, your lawer will know, what is best for your case.

Problem with the old experience letters is that often, it will not specify in what skillset we worked on. They just mention the duration and salary etc. As per my lawyer, I could not use the old letters that I got from old employers when I left them. For I140, these exp letters/affidavits should mention exactly what skills you worked on and your duties in the job, duration, contact details for the person issuing the letter etc.

I know getting these letters in the required format from the previous employers is really a pain, particularly from India. So I did not even bother to consider my Indian Company exp for the I140. My lawyer asked me to not to worry about the exp letters which are not in the required format (if I can not get a new one) or did not mention the required skillset for the job.
