Experience at client (who is current employer) counts for EB2?

Dear group,

Here is my scenario:

Educational Background:
B.Tech in C.S.
M.S in C.S.
3 Professional certifications related to the job I am currently in.

Exp:
I have started as a consultant at a client location. After consulting for 15 months they offered me a fulltime position. I have been working at the client as a fulltime employ for past 11 months.

I have a past experience at my school as a student worker / teaching assistant.

1> How can I qualify for applying in EB2 category?

2> Can the experience at the client ( when I was consulting) and after converting into fulltime ,be considered/used for EB2 eligibility.

3> I have received 3 certifications of which I completed 2 before starting as a consultant at the client. Can the 3rd certification be considered for EB2 (which I recieved when I was a consultant at this place).

I believe the best option for you is to do MS+0 only. Is your MS from US, this is extremely important question? Otherwise, I see some people have problems with evaluations. But if your MS is definitely after BS, then I believe it should not be a problem even if it is a non-US degree.

So if your degree is a 100% MS, then use only this and 0 experience. I went with MS+2, and I found out it was causing a headache. I did not have any problems at all, but all I saying is I could have been better without it. Look at it this way, if you use experience, then at I-140 stage you will have to provide experience letters, makes it harder, right? So my advice is use 0 experience, MS+0 is a perfect EB2 category.

If the position requires BS+5 Years, can the alternate requirement be MS+0.
I heard 2 years of experience can be counted intead of MS, if that is the case then isn't it that BS+5 years is equivalet to MS+3?

and for EB2 is it required that the requirment be atleast BS+5 ?

I don't believe BS+5 equals MS+3. What is your education? If MS, then put as number 1 requirement MS+0, then if you want to in alternate requirement use BS+5. And yes, for EB2 you have to have at leat BS+5 requirement or MS? Good luck!

Also, I am working as a s/w engg. and it seems like my position requirment from O*Net would require it to be only Job Zone Four which has a SVP (7.0 to < 8.0) meaning a total max requirment of education + experience + training can be a max of 4 years. And M.S. itself will be considered as equivalent to 4 years. Only B.S is considered as equivalent to 2 years. If we put a primary requirement of M.S+0 or an aleternate requirment of B.S. + 5, there is a possibility that the alternate requirement being considered as being not equivalent to M.S +0.

Eventhough for I-140 M.S.+0 or B.S.+5 is considered as equivalent, this looks like it could be an issue for Perm labor.

Please advice.

Can someone please advice if the following postion requirment description for labor will cause any problem when applying for either perm labor or I-140 in EB-2:
Masters degree in Computer Science or a related field; or a Bachelor's degree in Computer Science plus 2 years of relevant experience.

I don't understand the issue here. If your job requirement says MS+0 or BS+5 (that qualifies you for EB2) and as long as you meet one of them you are good. This is very common.

You are right, it wouldn't be a problem for I-140. But for perm labor, my position should not require more than a total of 4 years of education + training + experience which is equivalent to B.S. + 2 OR M.S
and Hence my concern is if we put M.S. or B.S.+5, will my labor get denied?

FYI, the position I will be eligible for has a O*Net code of 15-1031.00

Please advice.

Does anyone has any feedback on this? If job zone 5 is a requirement to apply for EB2, it'll be a waste of time for most people to even try.
