Expedite FBI name check

What a crock...

Thanks for the info Fresno but I'm just pissed off at how USCIS uses the excuse of "Security" to hide their inefficiencies. Are they trying to tell us that its OK for them to take two to three years to do the security/background checks on terrorists? They can be here for that long and act on their evil intentions while USCIS is busy doing their background check? Security should be the utmost and on top of the list for all the reasons to expedite these checks.
To top off, a terrorist is not going to file a Writ on Mandamus to expedite his/her background checks to get caught quicker:eek:
God please give us all strength and patience to deal with this agency...:o
 
I am with you on this one, like the suspected terrorists would wait till their name check clears and then they will commit their crimes!!
i think we need somebody intelligent enough to run this agency.

You guys think that name check only means for terrorists? And you really think a terrorist will actually apply for an immigration benefit just to be checked by USCIS?? Are you guys that naive?????????????

Name check is not just for suspected terrorists. Lets say you are a witness in a shooting or drug bust or anything else that may require your name to be put in the fbi system. If somoene beats his wife and is not arrested but a cop comes to his house, his name would be in a system where somoene has to check what is it for.

So name check is not as you are making it to be. Name check can mean million things...

If what you are saying is true then why USCIS can't defend themselves in court when 99% of WOM is filed. Instead, those cases used to be resolved very mysteriously upon the arrival of date when USCIS has to come up with the reason for the delay.
If you read the release below carefully, they are using the "security of the nation" card which clearly points towards the potential terrorist suspects.

Ofcourse I agree that its a ploy. However security of nation can also mean to check a psycho who has repeatdly tried to kill his wife. He is not a terrorist but maybe a threat to society? Yes No? They also talk about those who seek benefit by fraud etc. Meaning someone with 2 names etc like that.

9 out of 10 applicants name checks are waiting in limbo for no apparent reasons, however, the way USCIS works, that 1 person hurts others chances. I am also sure that people from highly-profiled countries wait longer to clear name checks than those from non-profiled ones.

The best thing to do is to file a suit if you think your wait is too long.

Well, I'm not against the extra scrutiny where its needed but there have been cases where they have delayed cases of legit candidates for no good reasons. For example, a single woman, mother of two, working as a clerk at Walmart, no criminal history, been here for twenty years. She didn't even travelled much internatioanally. Her case was pending for a little over two years. She waited patiently and asked her Senator for his help. USCIS kept telling her and Senator that her name check is pending. Later, she found out that her case was actually pending because she has two files with two alien numbers and has the adjudiaction officer done his job on following up with the other office after requesting her file, she would have been done long time ago. Those kind of legit cases where USCIS had used the name check excuse to brush off the applicants and even Senators/Congressmen/Ombudsman office, WOM did wonders. Now after this memo, I think filing WOM is not going to do a damn thing. That's where my frustration lies. I don't have any problem USCIS doing a thorough name and background check as long as they do it efficiently and don't leave some cases in limbo. Also, they need to be honest with the applicants and tell them that their name check is pending if that is actually the case, instead of using this as a generic response. Also, there should be a deadline to whatever the maximum time they think they will need, it could be five to six months, which I think should be enough in this era of technology, don't you?

Agree but unless a congressman's foreign born wife is stuck in a namecheck, it will not change.

So lets pray some guy in the capitol marries a foreigner...and then he will know about fees, wait times, frustrations etc.

Basically USCIS has shown their "middle finger" to the US justice system on the grounds for fighting terrorism as an excuse. One more tool in their arsenal for screwing immigrants!!!
 
Actually, this is a bit more complicated than it looks on the surface. If you recall, in early January the BCS or Background Check System was launched by the USCIS. And now, they are wanting to increase the application fees so they can get more money. How are all these related to the name check you ask?

Well believe it or not, a lot of individuals waited because the IO took his/her time retrieving the results back from the database. Meaning it took multiple systems to request the various checks (ie. name check, background check, FBI fingerprint check, IBIS check, etc). The results may have been ready for weeks, but it was up to the IO to retrieve it. The BCS system fixed that problem by creating a centralized system to initiate ALL checks and the IOs are notified of any updates to cases they are working on. Basically a one-stop-shop for them.

So, now add to the what the increase in fees will do for USCIS... Did you know that the FBI name check process is currently not fully funded by USCIS. Meaning, the FBI has to foot some of the costs and USCIS can only pay for a certain amount of "work time" per month. So, if the USCIS work demands 12 staffers (and this is hypothetical) and they can only fund 6 - the work gets backlogged. Well, the increase in the fee structure includes about $32 million per fiscal year to fully fund (thats in addition to what USCIS pays the FBI now) the name check process.

So, I am thinking (and this positivity towards USCIS is rather rare for me) that they issued this memo because once everything is implemented or starts working together, there should be no issues. In other words, with the BCS system and the fully funded name check process/staff - applicants should get faster results. I actually visited the FBI site and they specifically talk about their processing times. I was amazed at home fast they turned around the name checks - they quote shorter times than the USCIS quote. Which indicates to me that the USCIS has built in buffers to allow IOs time to retrieve results, etc.

Any way... there will be time to prove my hypothesis right or wrong.
