I recently got my PERM approved for an EB2 category job position. I am from India.I find that the I-485 numbers are unavailable in Aug to apply for this category. However I can apply for the 140 (correct?).But have there been any guesses about what the priority date will be in October 2006(when they expect new numbers to open up)?

u must be kiddin

Dude,

U got to be kiddin, if u think u can file for 485 :) few hundred thousands are ahead of you :D

pal,
I know few thousand will be ahead of me in the line to get 485.What I wanted to know though was before the numbers became unavailable roughly which year's (priority date) 485 were being processed for India for the EB2 category.( that will help in making a probable guess for oct 2006)
I just want some rough guesses here, whether my wait will be 4 yrs,5..6 or 10....:)

Apprecite it!

wild guess

I hope all category will be current on Oct 2006, however, the reality is it could be several years. 4, 5, and 10 are all possibilities
Preaper for the worst and hope the best

Expected EB2 priority date in Oct 06?

EB2 India: Jan 2003 or July 2003.
Hopefully July 2003

A good way to ensure all EB Visas gets attention

How about this ? a 2 Year Push on a STACK ?
1. To be fair to all, Ask all h1b's to gain 2 - 3 years of US experience, before filing for GC. (2 years of Paystub at the minumum and or tax returns).

If there are pending apps already, at LC or 140 stage, push it on a 2 or 3 year stack and then get the h1b who has applied the GC a preference to start the process. This will ensure the oldest apps gets its merit of preference. Do it across all categories (Eb1, Eb2 , Eb3 )

This is not too much to ask, also senators and companies - business cannot feel bitter. Also the system will allow DOL more time to focus on existing applns.

This will make the system slow down on the new applications, it will not jam the existing Que.

(2) Second Possibility, ask all the new h1 B's who have contributed by way of taxes to US system of an amount of 80,000 USD or higher to be eligible, that way only the cream of strata is not eliminated. For instance if someone earns 125000 then he can submit his app after a year. This will demonstrate the guy is smart and needed here, since companies will not pay 125K for a guy who is not worth.

(3) H1Bs should apply for GC from their home country and processing is to be based in their home country for the first 2 stages. (This will reduce DOL to focus on the 485 strictly, so it will reduce work load)

(4) Ask all h1b to submit the tax returns for the last 3 consecutive years to show they all are legal residents, this will help on name check !

immi2006.....sorry for being brazen.........but on what kind of stack will you push 11 million illegal immigrants who will land in the same queue??

fact: USA immigrations system is mostly unplanned......they dont care because their citizens dont suffer......and most of the times they have to do vote politics......hence they can add millions on top of existing inefficiency......

and this will continue as long as skilled people make usa their #1 destination......simple demand and suppply....

Lets just wait and see ...

Guys and Gals,

Hopefully India EB2 will move by a few months. If it doesn't then we will know that there are a lot of EB2 India pending prior to Jan '03.

The best strategy is to stop speculating and just wait for the bulletin. Things are totally out of our control.

EB2 Spillover

Hi,

When the spillover for EB2 is going to happen? i.e. excess visas from ROW EB2 to India and China and if anybody knows about the numbers for the same.

Thanks,

I tried to be an oracle and I pulled data (Oil futures) from NYMEX, weather data from the satellites, forward swap curves from LIBOR and option futures from Chicago Exchange. I used some political future forecast by the Democrats and financial forecast of US Deficit by the Republicans from the treasury. I simulated some variables (like
When will they stop running Sweet 16 in MTV?,
Will they ever stop Friends re-runs?,
Will GW ever stop winking?,
The price of starbucks coffee and some dependent variables).
I approximated and cleansed the data. Then I put them through a simple NLP model (I should have used Black-Scholes, but I dont have a grip on PDEs yet) in MSExcel. It took two minutes and 34 seconds. I was looking for EB3 forecast for October and the result was "BLUE SCREEN, Unmountable Disk Volume". Another Hard disk in the garbage. :)

I will check the EB2 later through another model. May be I should use Linux then.

This is the coolest post I've seen in last 5 years (or in whatever time I can remember) :)

lynchbaby, before they went unavailable, india eb-2 was having Jan 2003 as the priority date (if i remember correctly) it was moving 6mons / per month of visa bulletin during the early stages of this year.....
hope this helps...
i would think you might need to wait for year and half possibly(barring no more unavailable statuses)...for you to file 485.

visa availability

Guys ... it's true that visas were moving in installments of 6 months uptill March/April this year. But since then, they have been on standstill. I noticed nobody observed that this could be associated to large number of LC approved in recent months (i.e. 1st and 2nd qtr of 2006) deom BEC's. The BEC's have been shooting for Sept06 as their target date.

Put this in prespective with visa non-availability. Since their are certain number of visas available and good indians who just earned reprieve from BEC's after languishing for years, wasted no time in applying for next step ...i.e. I-140/I-485. As you are aware the process works on PD, people in line for years at BEC's finally saw light at the end of the tunnel.

I know my attempt on putting together a logical reasoning to this absurd process doesn't help any bit more. But like you all I am hanging in their!
