Expat Assignment soon after Green Card

Hello,

My father is going to receive his green card soon (family based case). He has been offered a very good assignment overseas by a US firm for an extended period of time (1-3 years).

My question is....Is it ok to leave the US for such a long assignment soon after getting a GC? If so, how soon is it advisable for him to leave the US after the GC? Also, would a re-entry permit suffice to maintain his GC status.

In order for your dad to preserve his residency, while working abroad for a long period, he would need to file form N-470. However, he can do so after he spends a year in the US from date he received his green card. The best thing for dad would be to wait for one year after he gets his green, then accpet a position abroad and file N-470. Otherwise, he may get in trouble.

reentry permit will allow him to stay abroad for 2 years maximum and then come back and apply again. The second permit mostly will be delayed, denied or approved for maximum of one year, if he is soooo lucky the second will be approved for another 2 years. He can leave the state the second day he got his GC even with permit for period less than 6 months.
