Hi Vedatman,
I am in a similar situation. I complete my 180 days mid-May and I am planning to join the client directly after that. Then
1. Would Rapidigm cause me any problems in this case?
2. In case I am getting a lesser salary than what is stated in my 485 petition, would it be a problem?
3. Is it true that salary is determined by the category in which your labor was filed i.e. EB2-RIR, EB2, EB3, etc?

Hi

If you have completed 180 days then you dont have any problem, You may have to change the lawyer even that may not be needed if there is no RFE or your RFE is straightforward.

Salary and Location are not determining factors, You need to only have same job profile

Salary has no bearing on the category , These categories are determined by your educational qualifications and work experience.

Thanks a lot Vedatman for the quick reply. A few more questions:-
1. As per your reply, it appears that one has to resign from Rapidigm after 180 days and join the new company. Is this assumption correct?
2. What would be a same job profile? I mean is a software engineer same as developer OR a senior software engineer same as senior developer. Or is it that the job description should have details containing the duties and the roles that you perform?
3. As per this thread of discussion, I understand that Rapidigm only informs the INS that they have withdrawn as counsel for the applicant. Is that a sufficient cause to generate an RFE?
4. Lastly, was your case the same or similar? I mean did you resign from Rapidigm after 180 days and then Rapidigm informed INS that they no longer are the legal counsel or were there any other issues?

Generation of RFE depends on INS, You may even get approval without RFE or your RFE would be just to provide offer letter and pay stub. If I were you I would not concern myself too much with RFEs.

I have been terminated before 180 days, Rapidigm will inform INS anytime.

Pl consult the immigration lawyer in your company that will be useful

BTW, What practice do you belong to ? Are you in Peoplesoft?

if rapidigm informs INs . How will it effect GC? How do we know if GC is continuing or not? Does INs send any letter regarding this

Since Rapidigm informs INS that only counsel is being withdrawn, it would not affect GC in any way

YOu can check the automated voice mesgs at the INS

Had some questions,
1. If Rapidigm just informs the INS that they have withdrawan Legal Counsel, would INS generate an RFE based on that?
2. When does Rapidigm return the birth certificates and the degree certificate, I mean once you end employment with them, they mail it to you? Or do you have to specifically ask them for it?

I don\'t thing they will inform to INS about withdrawing counsel. They reason I said was it may create issues like future H1 approval and LC approval. So far I have not got my BC and my marriage certificate from them. If they would have informed their attorney they might have sent our originals back. Won\'t they?

How did you guys change your job, was it based on your LC job description? did you guys get your 140 copy? Pls. Share your experience.

BrianK, I am still with Rapidigm, but just looking into the possibility of a job change as client doesn\'t want to continue the contract. So I can\'t really comment on your questions right now.

Can anyone tell me if Rapidigm asks for Original documents for the I-485 Processing. If yes, what documents do they ask for?

They Have Changed their Policy.

They are not asking any originals. Now they want only the copies of Birth Certi and Marriage Certi.
