Rapidigm , Termination and GC process
For terminated H employees, the Immigration Department will notify the INS and DOL immediately thereafter to withdraw the H-1B. This is a requirement and is not discretionary. Therefore, should Rapidigm wish to re-hire the employee, a new H-1B Petition must be filed.
If the employee has begun processing his/her Green Card and is then terminated or resigns, Rapidigm will notify the Service Center of such termination and will withdraw as counsel for the employee. A letter will be sent by the Immigration Department to the terminated employee advising the employee to obtain new counsel and informing him/her that Rapidigm has withdrawn as counsel of record. If re-hired, Rapidigm would again notify the Service Center that we are the counsel again.
