EVL - problem

My company is giving me EVL (Employment Verification Letter) stating,

1- Date of Hire
2- Title/Position
3- Salary
4- Permanent nature of employment

but are refusing to include,

5- Job description
6- Intent to hire as a permanent employee once GC is approved
7- Size of company (though they have 6000+ employees) and ability to pay salary

They are saying they never include such things in EVL.

AC21 specifically requires that the new job is same or similar occupational classification. Also, point 6 is also important even though it is implied.


What do I do? Please help.

5- Job description
At least your position should have job description. If so ask them provide job description for your position. May be on separate letter. You can put that in your covering letter


6- Intent to hire as a permanent employee once GC is approved
There is no need to mention about the future. If they say you are working as a full time permanent employee that is all they need.



7- Size of company (though they have 6000+ employees) and ability to pay salary
No need to include in the EVL. Usually Company's ability to pay question will not be asked at I-485 stage. Do not even mention that.

6- Intent to hire as a permanent employee once GC is approved
----- This is important if you want to use AC21 from new employer. They have to write that they want to employ you on permanent basis after GC or I-485 approval.

AC21

Thanks to tammy2 and ginnu.

What I am looking for is a set of documents that I need to send for AC21. I have made a list.

1. A cover letter stating the use of AC21, the law, its section # etc. and my filing dates as well as eligibility. Any format is welcome.

2. Copy of AC21 memo published in Aug 2003.

3. Company letter (EVL), indicating salary, title, date of employment, nature of employment (fulltime/40 hr per wk), intent to hire as a permanent employee, and job description (same or similar to the one in LC)

4. Latest pay stubs.

5. Latest W2s.


Please correct me where I am wrong and please feel free to suggest me any additional document that I would need.

I am filing on my own and not using an attorney (Is it necessary to use an attorney?)

All the 5 documents are enough. If lawyer drafts your AC21 letter for future permanent job offer letter (company EVL letter item 3) please post the sample for others you can delete your name, company name from the sample it will help many.
