Evidence for Change of Status to TN1

Hello, My employer will be submitting the I-129 for the new TN1. I am currently on B2 Pending.
Q1-
Do they need to submit with the package the copy of my
1 Original I-94 from the previous TN1

AND / OR/ ONLY 2.

2 Copy of the B2 Pending receipt.

Q2 -
Also, in Part2 Q3 of I-129
Provide the most recent petition/application receipt number for the
beneficiary. If none exists, indicate "None."

Do i need to provide the B2 Pending petition/receipt number?

Please provide guidance.

Q1. Copy of B2 pending receipt
Q2. I-539 receipt number, as above
Neither of these are needed to get TN approval, but are needed to change your status to TN without having to go to the border.

Thanks for clarifying. Also, it it ok to mention TN category under NAFTA 1603 etc. or no need to mention NAFTA at all because in my earlier petitions there was always a mention of NAFTA but in current situation whether they will be looking for NAFTA or USMCA guidelines.

You are requesting TN. They know what that is. the box is for writing TN, nothing else. It is a check box everywhere else. The I-129 is your request for TN, anything else you send in is the needed proof.

The classification you are asking for is TN. period. If you must, use the wording inI-129 which is merely something like based on "a free Trade Agreement". it never refers to NAFTA. I think we can end this, no?

One last question. When submitting, does the employer need to attach TN offer letter - the one we take to the border or just the i-129 will suffice?

I'll answer this way: Does the I-129 have all the information required? And why are you asking about what should be in the letter, if you're not sure it should be attached.

I've never done an I-129 application but why would you suspect the supporting documentation for a TN application is different than at the border?
