Eoir 42b visa availability for FY 2019

I’m really debating here… I was verbally approved 3/22 so it should be near but my daughter is already 21 and I can apply with i130 and get it done … not sure if it’s better to pull the case from court and start USCIS process or to wait for the formal grant
I had the same scenario and my lawyer told me to wait for my green card.
If you start a process with your child, you will have to apply for an I130 and another I485.
The I130 is taking almost 1 year to process (based on child over 21) and only after that i130 is approved uscis will start working on your i485 (another year of processing) which puts you back into another 2 years of wait (or close to it).
Stay put, pray for patience and everything will be alright!

Your almost there honestly, by the time you submit everything and stuff. You should be receiving your approval. I'm just wondering why did the lawyer expedited your case before your daughter turned 21. Sometimes that can get you disqualified from the cancelation of removal. Finger cross not. Am not a lawyer but this is what I heard.
He did expedite but I was denied and they told me to wait in line….
 
hello everyone, I received my green card 6 months ago and I am ready to travel in October. But many people with green cards are choosing not to travel nowadays because of fear. Have any of you traveled recently? What kind of questions do they ask?
 
My wife and I had the last court in May 2024 in New York, but the judge did not make any decision, is it good news or should I worry, and if it is good news until when should I wait for the approval letter, and what are the next steps to follow, thank you

I am in the same situation. My best bet is to wait and see what the new fiscal year will bring. If we get granted in the first lot then I believe we will not need to withdraw from the 42B case. If not then I will personally pursue with the I-130.
It will really depend on how fast they are granting from October.

I have called the Court Today at Chicago, I asked for Case Status,
The representatives were so nice and they checked the status, here is what they told me,
"They Have a big back log, Average case takes about 4 years, Currently they are finishing up 2021 cases, your case is in FEB 2022 and I should expect waiting 6-12 months to get the approval in the mail." My attorney also said similar things, For Chicago average case takes 48 months,
So, Good luck everyone. My Verbal Approval FEB 2022, so, hopefully by April-May 2026 I will get it.

I am from NY 2022.You should ask your lawyer to expedite your case. My daughter going to turn 21 next year. I spoke to my lawyer she told me after my daughter turn 21 we need to apply i130 form.My lawyer try to Expedite my case before my daughter turn 21.Hopefully we all get it soon.

In the event that my son turns 21 and I have not received any approval, what would happen with my case?
Not too sure but I think you become ineligible, but there a few people here And there waiting and their kid turn 21. That I know I think closer to your child is turned 21 they can try to expedite your case. Again, this is the information I gotten being in the forum for a while.

Thanks for letting us know. What documents did your husband bring to his appointment? I changed lawyers because he wanted to charge me $7,000 to remove the monitor. To put this in context, I had a good lawyer, but he became an immigration judge and could no longer handle my case. He was an excellent lawyer; I hired another one, but unfortunately, these lawyers disappointed me. We hope the ones I just hired can do something.
Sorry on late response, he took work permit and driver license. We had a letter his lawyer made explaining we were waiting for his granted letter but we didn’t need it. They just rescheduled him for October. It’s annoying having to go every few months but it’s pretty simple and fast (at least for my husband’s case)
