Entry into US after I-130 if filed???

Hi,

I am single, over 21, a Canadian citizen living in Canada. My mother, who is Lawful Permanent Resident (LPR) and lives in the U.S., is petitioning to bring me in.

My question is: once the petition (I-130) is filed what are my options as far as entering the US? Can I go for visits? Can I go to school there?

Any help is greatly appreciated.

Depends on what visa you use to come to the US.

If you come under the visa waiver program you can only come here for 3 months. Which means you can visit but not study here unless you come with a F1 visa.

Having an I-130 filed does not grant you permission to live, study or work in the US. You can visit the US, but it is your job to prove at the POE that you do not intend to overstay/immigrate to the USA.

I do believe Canadian citizens do not need a visa to come to the States for a visit. Check out the US embassy website to see if you need a visa once I-130 is filed for you.

Turns out there is no special visa required to enter the US if you are a canadian citizen and waiting for your I-130 to be processed. Here is the link:

That is what I mentioned. The visa waiver program... unless you plan to study, work, whatever, then you would need a visa.
