Entering at San Francisco using AP

Hi all,

Quick question - I am planning to go to India (Madras) next week and will be returning in a couple of weeks. I have a valid AP and also an H-1B extension approval notice. The problem is that there are no interview dates available at the Madras consulate during my stay in India - so I cannot get my H-1B stamped there. Couple of questions:

1) Will there be any problem at Madras when I am returning to the US (since they usually look at your visa before you depart) - can I show them the AP? Will that be enough?

2) On return to SFO, I guess I should still stand in the Non- green card line for immigration - will it suffice to just show them the AP? Will there be an interview of some sort? Will they take my copy of the AP document (or just look at it)? Also, what should I fill out on the I-94 form etc for status?

1. AP is the travel document of choice for AOS applicants.
2. Since you are not a permanent resident or citizen, it should be pretty obvious which line you should stand in. You will need to show your AP to the officer at the desk and he will guide you to the secondary inspection room, where your papers will be inspected.
3. Write in your legal status on the I-94. Which should be AOS adjustee.

I also suggest you search the forum for more information on this, these issues have been much discussed and people have some extensive commentaries and experiences to report.
 
1. I travelled on AP 2 times from India - Hyd to SFO. they just see the AP document. No one asked me any questions in India.

2. I stood in the non GC/Citizen line in SFO. didn't have any problems there either..

I also travelled from Chennai to SFO using AP. No questions asked anywhere and no issues. Went for secondary inspection at SFO, took only about 5 min. You will get the stamp on your AP and they will return the AP to you.

You can even go out to Singapore showing your H1 and/or AP.
