Enter US on H4 while husband is in India

Hi,
My husband is on H1 and I am on H4. We have been living in US for more than 6yrs. Now we came to visit India and we are planning to return around the end of march. We both have valid visas.
I am planning to return on 28th March as I am planning to file my H1 on 2nd April.My husband wants to return on 31st march. Is it ok for a H4 visa holder to enter US while husband is in India? Am I going face any questions at the immigration? Please reply back. Thank you.

let your husband come with you on 28th or you come with him on 31
 
Thanks for the reply. But my husband cannot make it before 31st. I want to return earlier as there are predictions that the H1 cap will be completed within a week. I need to send papers to my employer. So, please let me know if it is ok to do so. Thanks.
 
H1 b transfer enquiry?

I have an H1 b visa for employer A.Now i am currently working in oraganisation A. Can i travel to USA for employer B?.Some of my friend told that you can travel the existing visa to USA and then you can transfer the visa.How long it will take to transfer the visa from organisation A to organisation B . Is it legel to travel to another employer B with holding H1 B visa for employer A ...plz help me ..i am awaiting your reply

H4 visa is based on your spouse H1 status and one can be on H1 status while in US. if he is not in US and you try to enter US on H4 you may be stoped at POE.
send the papers to your employer by fedex so that employer can file H1. you need to only send copy of your passport pages, education degree certificates,exp letters. your presence is not required to file H1 it is employer or his lawyer who has to get LCA for you and then have to file the papers with USCIS.

if you have visa stamp of A and you are going to work with A you can enter. if you are not going to work with A or A does not have job for you and you dont have H1 Transfer approval of B in hand at the time you enter US then you can be sent back from POE as you dont have job with A or A may have revoked your H1 by writing to USCIS.

Transfer can be filed only in US when you have valid I-94 and have recent pay stubs. Transfer can take 4-5 months but if person is on valid H1 status in US and B file the H1 transfer with the USCIS and once the employer gets H1 transfer filing reciept from USCIS(in 12-20days) one can join B or if B file H1 transfer with Premium processing($1000 extra) then H1 transfer can be approved in 20-25 days.
