enter on B1 b2 with valid H1B, change entry status

hi everyone,

i have my h1b stamped already in India in June. i had to come to US on my current employer business. it was for one month and i entered in july. the immigration gave me I94 for three months, till October 22. So they extended my trip to three months. Now my H1B is valid from Oct 1st.

Can I start working on H1B? If yes, how can I change my entry from B1/B2 to H1B since the current I94 expires on Oct 22. I was thinking of going out of country by going to Mexico and the entering back the same day and now enter on H1B status. How should I proceed?

Can anyone advice?

I heard it is necessary to get Mexico visa to enter Mexico. My boss is going with me, he is US citizen, we are going to drive in to Mexico from San Diego and then drive back in and fly back to SFO. I also heard that even though the permit/visa is required, they dont care or ask. Is it safe to go this way? My I94 expires on Oct 22 and I would like to do this legally, by getting visa and going to Mexico, but it takes 3 weeks to get Mexico visa. what are my options?

the immigration officer when i entered in July was very nice and sweet, without even asking me how long i want to stay, he gave me 3 months, then he asked what status i want to enter - b1 b2 or h1b. i said b1 b2. he noted b1 b2 and let me in. i am hoping since i already have visa stamped, i shouldnt have problems when i exit and enter. is it mandatory to have 3, 4 days between entry and exit? my current plan is to exit, and enter after couple of hours.

please note: I have my H1B already stamped. I just need to know how to extend my I94 to 1 yr or 3 yrs instead of expiring on Oct 22, 2007
