Hi!
I'm trying to convince myself that It would be OK for me to changes jobs once my I-485 get past the 180-day period. To be completely eligible for AC21, my new job duties need to be deemed "similar" to the one used in my LC. This comparison is very subjective: I might think that the 2 jobs are similar, but the USCIS official might think otherwise. My questions are as follows:
1) How could I help ensure a better chance of being deemed similar? the job duties I'm comparing are about 80% similar in my opinion, but the remaining 20% is what worries me. Could anyone share their experiences regarding this? Those whose AC21 were successful, how "similar" were your job descriptions?
2) I'm thinking of going to an immigration attorney to help me decide if the 2 jobs will be deemed similar by USCIS before finally accepting any offer from the new employer. Did anyone do this? If you did, can you share your experience and let me know if the attorney was very helpful?
3) IN CASE that USCIS declared the 2 jobs as NOT SIMILAR, what are my options to save my I-485? Is there anything an attorney can do for me? In case it cannot be saved, will I have at least the option to start again with my new employer (i.e., new employer files H1B, then files LC/I140/AP/I-485)?
I hope you can share your wisdom/comments/experiences regarding any of the above. I thank you all in advance.
