I am in the same boat
Mine is PERM substitute which was filed on 9/29.My checks was not cashed it.
My Attorney contacted AILA and AILA tracked my packet at Vermont.
Vermont service center people called my attorney saying that,there is no ETA-750 form on my packet.
My attorney said"this is PERM case.For PERM sustitutes,we need ETA-9089 not ETA-750"
Then they said "we are going to reprocess my application"
It is better ask your Attorney to contact AILA on this.

The September was a over flooded month for applications. USCIS is still working/reviewing applications received on or before Sep 05. Current processing of VSC for I485 shows Ist Dec, 05 for last three months. USCIS did not move a little could be the reason that they are working on application received in the month of Sep, 05.Gcquest27 said:My application for 140/485 reached VSC on 28th sep. Thanks for your suggestion blocklisted. i will call my attorney about AILA. actually my situation is crucial. My 140 got rejected in july due to ability to pay issue. and I filed for my 8th year extension. in that I got RFE stating I dont have any pending application. So I filed my 140/485 on 28th. Now I need that receipt number for H1 RFE. my current h1 is expirying in december. so each passing day i am getting worried about this receipt number.
Please advice me if i have any other options to reply my RFE.

If not, who did send the check for H1B fee?
Whoever sent the check, there should be a EAC-NUMBER back on the check cashed by USCIS and returned by bank.
Using this EAC-Number, check the online status and get a hard copy of it and attach it with the covering letter being sent to USCIS in response to your RFE.
If none of the above is available, then contact with USCIS with reference to the postal date and receipt date of the application to the service center. The date can be found using tracking number of respective carrier's reciept.
I am sure this could work out to prove it against query raised in the RFE.
