My OPT expires January 4th, 2007, USCIS received my application for H1 May 19th, 2006 and sent me a notice saying that the case was delayed due to background checks bse I was born in Afghanistan (although Im a French citizen and raised all my life in france). I am worried bse my OPT will end soon and I have no idea when the check will be done. Apparently it was sent for the check End of OCt., Beginning of November. I do not want to lose my position knowing that my work authorization will end and that the H1 will not kick on time. Worst case scenario, how long can I stay in the US? is it until I get an approval or denial, or is it the 60 days grace period. Also, if i do get the approval after my OPT ends, can I transfer it to any other company or do I have to at least work few days with the petitioner?
