The (relative) abundance of approvals we are seeing is very encouraging. VSC had stated that once H1-B1 cases had capped, attention could be turned to the I-140 backlog. It appears that that is what is happening.

One thing that is sorely needed is some activity in the 'discretionary' cases - EB1/NIW. Those cases have barely moved in over a year; I suspect we are soon to see a flurry of activity in that area.

I really don't have a question ... just wanted to spread a positive thought.

I really hope they could start working on NIW whose processing date has been staggering at June of 2002 for more than a year. I can't understand CIS' unwillingness to work on NIW and OR. based on their current processing dates there will not be any advantage to apply for NIW or OR.
 
I agree. Although, at least in New York, a two year wait for NIW or EB1 is still substantially better than going with LC and a regular EB2.

They have stalled on these applications for a reason ... we just don't know what it is. I think there are two likely scenarios: (1) There is some confusion within the service as to rulings, and they are waiting for guidance as to how to evaluate these applications; or (2) there are a small number of officers who have the expertise to evaluate NIW/EB1, and these few people have been allocated elsewhere for some pressing reason. Seeing activity in NIW/EB1 probably will represent the work of only a few people.

It is very frustrating, yes. Especially since NIW is the application with the most uncertaintly attached to it. But have faith. At some point they are going to say, "OK, it's time to go back to processing NIW/EB1, and we should see a significant jump in activity. Remember that the notice says 485 days, so there is something of a target there.
