Employment verification letter -- is this good enough

USCIS asks for a letter from my current employer stating: Hire date, job duties, compensation and job prospects.

Following is the letter my employer give me, do you think this is good enough?

To whom it may concern:

This letter is to certify that XXX is an active employee at XXX since XXX, 2003. His job Tiltle is Programmer I. He is employed through our XXX office. His current salary is $XXXXX.

You did not write if you need that letter to invoke AC21, if it is to invoke AC21 then find the sample letter that was used by someone and recently got I-485 approved:


TO WHOSOEVER IT MAY CONCERN


Date:
Dear Sir/Madam:

This is to certify that XYZ is a permanent fulltime employee at our company ABCD Inc.

XYZ has been with us since…………... His annual salary is XXXXX and his job duties include:***************************************************


We expect to continue employ him.

Accordingly, we respectfully request that you grant his approval of the I-485 application/Immigrant Visa in order for him and his family to obtain their permanent residency status soon. Thank you for your assistance.

My company representative said this is the only employment letter they will provide. They won't add employment prospects or use the template I provided.

Now the question is: Will my employment verification letter be OK?
 
I do have an offer letter from the employer (not my current employer) who filed my I140 that they are going to hire me after I get my GC. Will that be good enough?

you seem to be confused and you did not write if new letter is needed to invoke AC21 or just to be attached withI-485 filing

it seems to me that your LC and I-140 is filed by employer A and you are working with B at this time.

*** if you want to work with B after I-485 approval then you need to Invoke AC21 BEFORE I-485 gets approved and you need the PERMANENT JOB OFFER letter from B with same/similar job duties.
** if you want to work with A after I-485 approval then you need the letter of A, if that is the case then you must have attached letter from A at the time of I-485 filing.
* why you cant be more clear and post what is your situation and what you want? to work with A or B after I-485 approval any why the USCIS is asking for the letter, better if you post the full details so that others can understand your correct situation

Sorry I confused you guys.

I worked for company A for a year and filed LC through A. After that, I started to work for company B. While I was working for B, LC through A is approved and A filed I140 and I485 for me.

USCIS request employment letter from both my current company B and prospective company A for hire date, job duty, compensation and prospects of employment.

I have job offer letter from A which states A will offer me a LC specified position once I get GC.

B is only willing to provide the following letter:

To whom it may concern:

This letter is to certify that XXX is an active employee at XXX since XXX, 2003. His job Tiltle is Programmer I. He is employed through our XXX office. His current salary is $XXXXX.


I ask B to provide a letter according to template and B refused and said they checked with immigration attorney and that the above letter is sufficient.

I want to work for B after GC but now it seems B is going to leave me in the limbo. Very depressed right now. I don't want my GC denied after almost 10 years in USA.

Friends on the forum, any suggestions?

------------------- I am confused why USCIS asked letter from BOTH employers,It seems that employer A or you did not send employer A job offer letter at the time of filing I-485 it was supposed to be attached with I-485 petition, if that is true then they want check the intent of employer A and they are asking employer B job offer letter so that they can approve your I-485 for B under AC21

----------------- you should ask that attorney that you need to use AC21 and that letter does not have permanent job offer, job duties and how you will be able to use AC21???? or let the same attorney reply to USCIS and then attorney will understand that the above letter is not correct to use for invoking AC21

Company A (my sponsoring company) provide supporting letter when we filed 140/485 concurrently.

I don't know why USCIS asking for letters from both current employer and prospective employer. I am working on EAD right now. I used H-1B joined company B.
 
I also got the same RFE for my I485. I am also working for company B and company A filed my GC. They want same letter form company A and B.

We did provide the job offer from company A along with I485 filing. I do have EAD but never used it and still working with B on there h1. I don't want to use AC21 and willing to join company A after the 485 approval. My attorney is preparing both the letter and hopefully A & B will provide it.

My issue is: company B's employment letter is not good enough for AC21. I do have job offer from company A. But I hope I can work for company B after GC. What should I do?

--------------- contact good lawyer and only send A job offer letter( that letter should be with recent date on it) and let the lawyer explain on cover letter that you Intend to work with A after I-485 approval and not with B( the office looking at your file thaught that you will invoke AC21 that is why he asked B job offer letter)
But I hope I can work for company B after GC.
------------ after I-485 approval you need to work with A for 6 months to be safe if you get GC through A job offer letter( this 6 month has been discussed many times in many threads)
*** you are geting I-485 approved on the base of employer A job offer letter and dont want to work with A and want to work with B after GC, dont you think it is fraud on your part? you are using A just to get GC and not to work with A. B is not giving you job offer letter to use AC21? why you should work with them? they are not helping you to get GC approved for them
What should I do?
----------------------- go to good lawyer or make employer B understand what letter you need from B if they want you after GC and make it clear to them that you cant cheat A or USCIS, if you submit employer A letter then you have to go for A and you dont want to create problems for your GC if they want you then B need to give you permanent job offer letter with same similar job duties
 
I joined company B because company was OK to help me with GC. I work in local office and HR is in headquarter somewhere else. HR used to have immigration department. Now they outsourced immigration issue to another law firm. HR representative insist the letter they provided is good enough for GC purpose and they checked it with their immigration attorney. However I have my own attorney and he said the letter is not good enough.

I don't want to commit fraud, but it seems I am the victim of company B.

After I talked to my immediate manager, she agrees to sign the following letter, will this be good?

TO: U.S. Citizenship and Immigration Services

RE: Employment verification and continued employment
XXX is currently employed by XXX in our Washington, DC office since XXX, 2003. His job title is Programmer I. His salary is $XX,000/year.

The duties are: the same as LC

We look forward to his continued employment with our company.

better add: XYZ will be permanentlty employed by (company name) after his I-485 approval.
