Hi ,

I got an RFE for emloyment. Can anyone provide me list of what documents required to reply for RFE.

My Status : Changed employer after 1.5 years of I-485 .

Can myself reply for RFE as my attorneys ( Old employer attorney is not responding and employer is alos not favouring ).

Do we require the labor certificate, I-140 papers to incoke AC-21
or Just send the current employment letter to INS.

Just employment letter

Here is what it says on the RFE:

"If you have changed employers since filing your application for AOS, the letter shall be issued by your current and new prospective permanent employer. This letter must specify the duties of the position, requirements of the position, job title, wage, and the date you actually began employment. This letter should be issued by the appropriate authority within the organization that has ability to confirm the job offer.

Finally, if you have changed employers since filing your application for AOS, please submit a statement including the names of all employers and the beginning and ending dates of each employment."

From what you read above, it sounds simple. Good luck.
 
That is what i got from INS.


" A currently issued letter or other evidence from the prospective permanent employer that indicates your current position, if any, your proffered position, and proffered wage and indicating that the terms and conditions of the employment petition continue to exist "

For reply to RFE on this - Just the employment letter stating position and salary are sufficient or do i need to send I-140 and Labor certification ( from previous employer ) . I-485 etc are reuqired. I changed the employer after 180 days
 
I don't think so

I don't believe you have to send LC or anything else. They are suppoed to have this (hopfully!). All they need is to make sure that you are doing a job similar to what you were approved for and getting a similar pay (along with an employer commitment of course).

Anyway, this is my feeling, and I suggest that you check with your lawyer...

I checked with lawyer and they said Labor and 140 are required to use AC21 cases. I am not sure about this , might be they are looking for some $$ for preparing doc's.
