To my understanding, knowledge and discussion with my attorney and employer, Employer letter is necessary to file I-485. Otherwise your application will return. I am surprised why your attorney is not considering that as a must item to file I-485. Actually the employer is still in the picture till you adopt AC21 and letter should show the intention of your employer that the positions is sill open and they want to continue with you and want to proceed with your AOS.

I am not sure about other, but I never heard a case where attorney or principle applicant file the case without Employer Letter.

Try to talk to your attorney with the help of your employer.

When was your I140 was approved. Is it very recently. Some attroneys are not very serious about EVL. But if it is not filed yet then you still have time to make sure to submit it.

I am in the same boat. My I140 is approved recently. My lawyer mentioned she will take care of the EVL. I heard they can use EVL less than 6 months old. She might be using the same EVL I used for 140 filing.

I think your lawyer is doing the same thing. By the way, where is your lawer located. My lawyer also has nasty attitude.. I wonder she is the same person you are talking about.

My I-140 was approved more than a year back....so there's no way she'd be using the old employment letter.....Anyways, I am thinking of letting her cool down a bit during the weekend and then call her again....if she doesnt reply appropriately, I'll tell my employer about that the gravity of this situation....to hell with her....

Guys, i spoke to employer and they said she is using the employment letter that was filed during I-140....but mine is like a year old....will that be accepted????

employer not giving Employement letter

If a lawyer can use EVL which he has used while filing I-140 that will be a great news ...bcause my prior-employer is not ready to give Future Employement verification letter. Just now I have moved to new employer (who knew dates will become current :(. My lawyer called up my prior-employer for EVL and upon receing negative reply my case is not moving forward at all :(

Any advice

I wish i knew.....Guys, do u think its for sure that if u dont submit EVL, USCIS will reject the application.....or cud they just give an RFE.....PLEASE ADVISE, this thought is making me crazy........

seems like my employer is also not submitting EVL...but hen my case 140 was approved in may so probably using the same old packet
