Do you know about entitlement with COBRA

Who is entitled, how to find, or by default everyone is entitled.

IF this can be found out from Insurance Company or current employer ..

OR they were already apying and you were not aware,

Pls list the steps that we can take care off so that our employer also pays employment Insurance.

My passport got stamped in last week of Aug 01.

why do we pay social security on H1, if we cannot get the benefit?

I don\'t understand why we are paying social security and Medicare on H1-B if we cannot get these benefits. The only way you can get these benefits is by becoming a permanent resident. Does that mean that paying social security and Medicare tax gives you the right to immigrate. I understand that America\'s law takes no responsibility of aliens or protects them, but if we are paying taxes as much as any American than we are entitled to same services that the government is delievering to an American.

This can argue either way. Many X-th generation Americans
can argue that the basic facilities are products of several generations\'s hardworking that can go as far back as 200 years
ago and the later foreigners(immigrants &nonimmigrants) get quick
access to these facilities immediately as they set foot on
American soil without making any contribution.

So the debate can go on forever.

18 countries signed SSA treaty with the USA where you can
pay taxes in one country but enjoy benefits in another.
Even if a country has no treaty with the USA, its citizen,
even without a GC, can still enjoy retirement benefits if
he/she pay SS taxes for 10 years. his can be done by
working on H1B for two cycles with staying outsie the
USA in the middle, or say, staying on F-1 for 4 years paying
SS taxes(*) on fellowship/asststantship, and 5(*) years on H1B.

(*) Student don\'t have to pay SS taxes but i know some
    managed to pay in order to get benefits as soon as
    possible.
(**)Yes, 5 years work can generate 6 years taxes if you H1B
    year start in the middle of a calendar year, in other words
    working from July 1 to June 30 next years means you pay
    SS taxes for two working years but working from Jan 1 to
    Dec 31 only qualify for 1 years even they earned teh same
    amount of money and pay the same amount of SS taxes (correct
    me if you think my reasoning is wrong)

I believe, Non-U.S. Citizens from countries that have no treaty with the U.S., have to reside in the U.S. to receive SS benefits from Uncle Sam.

What about if a worker has been working in a state other than the state where his/her employer has office?

For instance employer is in NJ and worker is in PA at client site.

Which state rules he falls under?

Hi,

I came across your reply, and I would like to ask you a few questions. I too recently got laid off, and now I am trying to claim benefits. What you said about alien registration number, is it the LIN number or the number on the I-94 card ? I applied, showed my SSN, passport, etc etc...I have a stamp on my passport, so it should not be a problem. Please let me know if you have claim before that went through without any fines. Thanks.

Is there any rule that says one shouldnot apply for Unemployment
benefits within 3 yrs of getting GC?
I got my GC last month and terminated in 4 weeks after getting GC.
Can I still apply for unemployment benefits. Will this negate my GC or
cause any problems later??

I\'m not sure that one must be with an employer for certain time. The amount of benefits is based on your employment earning in the last year.

- the amount is state specific. in my state it is a max. of $275/week.

living/working in different states

i live in NJ and work in NY. my employer\'s head office is in NY too. so which laws do i come under, NY or NJ?

could it be possible that i do not get benefits because i live in a different state?

You will get unemployment benefits (your case is same as those working in metros such as DC (live in VA or MD))
I don\'t know the answer. Call your state unemployment office (you can find the phone number on phone book or your state\'s web site).
