Generally a contracting company (between actual employer and employee) writes in the contract that employee cannot join actual employer.

Thus, it is true that employee cannot join actual employer because of contract.???

(Actual employer and Contracting company) are i suppose on 1099 contract.
(Contracting company and Employee) are on W2 contract.
 
I don't think there is any rule as such.

But the contracting co. can be sued by the client if they have an agreement on no-hire clause.
