Hello,

One of the company from NJ have promised to process my friend's H1. But on the offer letter they have written that employee will have to stay with the company for at least 1 year. How legal is this? In future can employer take undue adventage of this statement?

I believe that NJ follows the "Employment-At-Will" doctrine. Therefore, I don't believe that the employer can suggest on the offer letter a 1-year or any time bound employment condition.

There is no rule in US that allows an employer to bind an employee by contract. You are at your own will to leave or stay with any employer. It is illegal to bind you or ask you to pay a penalty to leave the company. You have a better chance of winning the case even if your employer files a law suit on you.
