I currently work in Company A (huge stable company) and have H1 from them. Company B ( a very small company , less than 50 ppl) wants me to join them.

Company B has offered to process future GC for me. So that I can join them after GC is approved. Now this is my concern:

How do I know that the poistion that Company B would apply GC for me is bonafide? I dont want this to happen that COmpany B is luring me with a false job. And if USCIS does determine that there is no bonafide job during the GC process, would that affect me (like getting deported etc)?

------Let the B file LC then I-140 for you.GC is for future job

GC is future job you can be with A if B file LC or I-140 and after I-140 approval with I-485 you just need B job offer letter. as back up why dont you ask company A to file LC and then I-140 for you ?

Company A has promised to file my GC after a year. It is a Fortune 500 company and is pretty stable and I would like to continue my H1 here as there is good job security.

Company B on the other hand is giving me a very exiciting opportunity (pay is a lot more), but since it's so small, i dont want to join them on H1 since who knows they might go bankrupt. So to convince me, they offered to process future GC, so I can join them after GC, and even if the company B goes bankrupt, i still will have GC.

But this is my question. Right now they are saying they have a Senior System Analyst job for me for which they can apply GC for. I have researched that the job must be bonafide for GC processing. I am afraid they might be lieing to me about this job and wanted to know if during GC processing USCIS determines its not a bonafide job, would I get into trouble?

From what I think, I shouldn't be getting into trouble, since I have no control on finding out whether the company is actually offering me a bonafide position or not. But I just wanted to confirm.
