Hello,

I am filing for AOS based on marriage to a USC. I have not received my EAD, but I want to start applying for jobs.

I filed on April 14, and already had my biometrics appointment. I have seen that the majority of applicants in this forum have received their EAD within a couple months after they submit their paperwork. Could you please share your experiences in obtaining jobs with the EAD?

1. What kind of status do you claim in the event that you get hired (before you receive the GC)?
2. Is this valid to apply for positions at large corporations where they require you to be a resident or a citizen to join?
3. In my personal experience it takes 4-6 months to land a position, and if I start now chances are I will have my paperwork done by the time I get an offer, does anyone know if there is anything wrong in doing this?

1. You must have a SSN and has an EAD since you will have to fill out the I-90 with your employer, stating that you are authorize to work in the US.
2. Regardless of the corporation/workplace/employer, everybody is under the same law. You must be authorize to work in the US, period. There are certain positions in some areas e.g. most of the federal employees, you must be a US citizen. Read the requirements on the positions that you are applying for.
3. There is nothing that states that you can't "apply" for a job although you should be very careful if you are stating that on your resume or in that application that you are a US citizen or a LPR when you are not.
 
I applied to jobs without even having an EAD, and I got the offer before I got my EAD and SSN. Obviously, I had to wait for my EAD card to arrive before I could start working. Once it arrived I notified my employer and they announced my start date and I came into the job without SSN, but like 1 month later I had my SSN. You can start working once you have your EAD and have submitted your request for a SSN.

Thank you banano, but while you were applying what did you say about your status, this company I really want to apply to, has a question in their application that says: are you a US person? (LPR or USC) and at this very moment obviosly I'm not, so I can't apply?

Yes, I'm aware that I need to be authorized to work, and obviously I can't say I'm a LPR or USC, but I just want to know if applying and leaving that part of the application process blank is fair (and legal.) There are no positions that I know of that do not require that you have a work permit, but like you said I can apply: my concern is what do I say about my status. I am no longer an F-1, but I have not received my GC either, if the question arises (after I get an offer) will I be in trouble by saying: "I should receive my EAD soon."
 
I don't see why you shouldn't start applying for jobs. Based on your timeline, you expect to receive your EAD sometime around mid-June. The process of getting a job takes time, especially for large corporations. You could claim that you are a GC holder when you apply for jobs, that way you would get more interview opportunities, then by the time, you could explain your case to the employer. Also, if the employer thinks that you are an excellent candidate, they would wait for you. You know soon or later you will get GC anyway. This is what I did when I applied for jobs several months ago while I was on OPT. When I had my first interview with my current employer, I told them that I was in the process of getting my GC, they told me not to worry about it (they know how the immigration process works). So… I suggest you to start applying for jobs now.
 
you can apply for jobs while you are waiting for your EAD. That is what i did. When they interviewed me i told them that i was waiting for my EAD. Generally its upto the company to decide if they want to wait for your EAD to arrive or if u have to start working immediately. usually they are pretty good about waiting for you to start unless they need you to start right away and you cannot do that without your EAD.

Wow, really? we can job hunt when we are waiting for our EAD card??? maybe ill start doing that too, pass some time while i wait for my ead. Hopefully itll arrive very soon.

I'm going to do that: job hunt is not fun either :D but at least it will give us something else to look forward to (and more interviews, and more forms to fill out...) :D

I started posting my resume last night, and i did mention on there that im in the process of getting my GC, and should recieve my EAD card hopefully sometime in June.

Sorry to hear you had start over, i just updated an old resume of mine i had found on one of my disks. I havnt had to look for a job in years, so im a little nervous about it all.
