Employer won't pay INS Fees

Dear Friends,

Using my Optional Practical Training, I am currently working for a County Public Health Department within a State Government. The State Government Human Resources claim it is their policy to not pay for the immigration corporate fees of $1,000. However, they are willing to sign and do all the neccessary paper work.

So, the situation is, my Employer can't issue a corporate check. What are my options? I would like to hear insight any one can offer on this issue. I will appreciate your help very much.

Well, if you wish to fight this problem as a rights issue, you should go ahead and insist the county pay all immigration fees (1000$ -premium processing fee? It id not a required immigration fee).
Beware H1s are nothing but indentiture servitude practitioners. You might get fired...

You're certaily correct, he could be terminated but that is true because nearly all employment in the US is "at will" not because an H-1 holder is an indentured servant, which he or she clearly is NOT.

Indentured servants were legally required to work for a specific employer for a set period of time. They could not quit, refuse to work, or change to another employer without being sold to the other employer for the remainder of their contract.

An H-1 worker may not be able to work for another employer in the US without filing for an H-1 "Transfer" but the person is ALWAYS free to resign and return to their home country.

To say that an H-1 worker is an indentured servant either is a demonstration of a lack of understanding of the H-1 system (clearly does not apply to Jaxen) or the meaning of the term "indentured servant, or is intentionally misleading.

Try this it might work. Convice the HR that you will bear the cost. Let them pay the $1000 but you basically pay-them - in essence you pay but route it through the countyl. Try and convince the HR of the problem and this possible solution.
