employer torture, does not reveal receipt number

My Employer tortures me, by not giving me receipt number for I-140. he is afraid I will leave him,once I get green card. its lot of stress to stay like this.

Is there a way, I can know, my receipt number or status of my I-140. I tried calling INS, but they are not ready to give any information without receipt number.

Please help.

Try contacting your local congressman

Give them your I-485 details if you have them.

Else just provide your name, address and birth date.

If you can convince them, they can help.

Spider,

You may not be able to get anything from Customer Service, so don't waste your time and be at their mercy.

If you have paid for 140 filling, you can get it from your cleared check.
if you have good terms with your attorney's paralegal, you can get it from them.

If your attorney is paid by your employer or 140 filling fees was paid by your employer, then you can't do anything.

Just file for your FOIA with your local office and you should hear from USCIS within 60 days. This will certainly work!!
 
I submitted FOIA around 60 days back, but havent received anything yet, how long does it normally take. Incase if we dont give the change of address, but definitely given a forwarding address, does FOIA information gets forwarded to new address???

I do not think any of the USCIS / DHS mail's will be forwarded unless otherwise noted.

If you are expecting a mail from USICS / DHS and have moved, submite a letter @ Postoffice to hold the letters and collect it every week, if you have moved locally.
Else
Take a PO BOX in the same post office and hand over the key, to your friends to collect & send you the mail, if you have moved out state.

I know, its a pain and might cost some money, but its worth it.

Generally it takes anywhere between 2-3 months and I got it in 2.5 months. It all depends upon, where your files are located.
 
I got mine FOIA reply with all I140 information and Labor copy 65 days after submit request
 
This is not fool proof but better than nothing.

If your 140 is filed concurrently and on same day with 485/EAD/AP then continue reading:

If you have 485/EAD/AP notices or case numbers then try to scan all cases for that particular day. Follow all 140 case numbers in general and 100 plus and minus your case number of 485/EAD/AP in particular. When you see a good number of cases done(I would suggest 80% done or more - my luck is not that good that I can suggest any less number) and almost all cases done in your case's vicinity, apply for FOIA.

If your employer doesn't gives you EAD/AP/485 case number, but tells you that it was filed with 140 on same day - wait 90 days. If you get your EAD/AP, check the case number and scan all the 140 cases for that date.

There are other things to be taken care of as well - if you make address change and file AR11 then try to locate if there is any LUD change for any of those cases! If you find one - try to track that case for sure. At this point you may try to contact your lawyer's office and confirm it.

Last but not least - if you know your employer won't give you numbers for sure - don't ask for it.

P.S. Allow some time between applying 140 and FOIA.

employer did not filed 485/EAD/AP.
He did not give attorney information too.
I feel he want to trap all employees, I do not know why he is doing this.


I explained him my problems, but he is not ready to listen.
I called INS, but they need receipt number.
What should I do, Please help me out.

i would suggest file FOIA.Even if you don't have receipt no for I140 you should be able to get it. other option is ask your lawyer to give you copy of the I140 receipt.(visit their office some one in the office should be kind enough do that) I was in a similar situation but lukly the lawyers office was very helpful...
 
Again, try contacting congressman

I am sure your employer is a desi.
They are our biggest enemies - in 90% of the cases.
But no point in complaining - we accepted them in the first place - many a times they are the only options. So pay the price....

Try to contact a Immigration Attorney

This is a horrible situation to be in. One option I was thinking of is to go to a good Immigration Attorney and see what their advise is. It might cost you a couple hundred bucks, but atleast you will have a good idea of what your legal options are. Just a suggestion. Do not panic, since it will work out well for you eventually.

That way people could avoid this company in future. Sunshine is the best defence.

If u paid the USCIS fee for 140 thru ur personal check....u can request the bank for its imprint. On its back u will find your 140 EAC# :)

He deducted money from my payroll, so there is no check getting processing !. I am getting depressed, as a registered user of this site replied me 'do you know if he filed 140 in first place'.

I am not understanding how to handle this situation. I tried many options, but nothing working out, Please help me.

1. did you file FOIA??

2. Did you try the paralegal or the reeptionist at lawyers' office

All you need is just the copy of the receipt you ask them to fax it to you..
 
Pleae send FOIA website information

I saw US Department of state have request form where they will accept visa requests.
I saw Service Center has request form to make request under FOIA.

SC say they will process only for the past petition, but not the one which is pending.

Please let me know, where to file FOIA for this type. Please provide website address if you guys have it.

I do not have attorney information too.

USICS will process FOIA for pending petition . i don't know where you got that info.

do you know your lawyer's name(firms' name)?? you can get it from H1 approval notice. once you get it check out the yellow pages..

believe_in_self - Do I need to contact specific immigration congressman, or just get immigration office. Pleas provide me some information on this, where to get correct congressman, if possible please provide the same congressman which you went to, so that I can contact too.
