Employer not paying me at par with other co-workers inspite of getting GC

I got my GC in March of 2003. I have been with the same company for almost 5 yrs now. I have been consistently underpaid by my employer.
I spoke to my boss about it and he agreed that my salary was in the low end of the range (I am one of the lowest paid) and that my performance was in the high end of the range. He said he would do something about it after doing a market survey. 2 months have passed since this conversation but I am yet to see a change in pay. My current salary is what was stated in my labor certification.
I am thinking of hiring a lawyer to sue my company for this discrimination. Need advise if this is a good idea or not. I am also looking for jobs, but am yet to find one. What are my chance of succeeding in getting my company to compensate me better? What are the risks?
Please advise. Thanks in advance.

Unfortunately there is no law that requires your salary to be same as others in similar position doing similar work. If you think you are being underpaid look for another job or ask for a raise.
You employer is paying you what he promised, i.e. LC salary.
Getting paid less is not discrimination unless you are doing the exact same job as another person and getting paid less than him.
This is only my personal opinion.

Is the employer paying you what the prevailing wage is as outlined in your labour certification, if LC is the route you took? If the employer is not, then the DOL may press fraud charges. Get a lawyer.
