My NIW-based I-140 was approved and now I'm filing for I-485. To my understanding, I don't need to submit the employer letter. But my attorney asked me to get it anyway. Is that really necessary? I work for a big company and I'll have to go through quite some bureaucracy to get the letter, which may be time-consuming and hence delay my application. So I try to avoid it. Can anybody share your experience and opinion? Thanks in advance.

Sooner or later, you would be asked to provide evidence that you are working in the area on which your NIW-140 was based and you don't have financial problem to live your life currently (not a potential burden of this country). The employer letter can be a good stone to kill those two birds.

GoFast, thanks a lot for your reply. What you said definitely makes sense. But from what I knew of other people's experinece, either their 485 got transferred to local office for interview or they were asked for an up-to-date employer letter even if they submitted one with the original application. In either case, the CIS officers asked for such evidence at the time when the 485s were abjudicated. Since CIS will ask an up-to-date one anyway, I think maybe I can just skip the letter now to save time so that I can get into the waiting line asap. When my 485 gets its turn, I will submit the letter.

By providing an employment letter from the beginning you might avoid an interview at all. I think if you include a letter from the beginning there will be less doubt for the USCIS officers that you will work in your area of expertice.
And is it really this difficult for you to get such a letter from your company ? I thought that very large companies have experience in writing such letters and it would be just a matter of a few days/weeks to get such a letter. (At least that is my experience)

You should take a look in all of the other threads about NIW and the requirements that will help you to find out if you have any chances.
To answer your question in a very short way: It doesn't help you if only your company writes a nice letter (it is absolutly useless) you need good recommendation letters from high-profile people in your research area who never worked with you before. That you don't have any publication is of course also not very helpful. And you have to prove that you are unique in your area of research and that the US would have advantages that if you could avoid LC (that is takes more time is no reason).
Overall I think you have no chances in NIW

Hi, honkman, thanks for your input. It's not difficult to get the letter, but just time-consuming. I guess I'm too impatient to wait for a week or 2 to get the letter. But now I calm down and I'm going to submit it with my application.
It's true that by clearing up everything in the 1st place, I might avoid interview. But from other people's experience that I've heard of, it seems the interview has become almost inevitable even for NIW-based I485. Can you please share your experience and knowledge about this (e.g. is it common for NIW cases to get interviews for AOS? Is there any pattern why some people got it while the others don't?). Appreciate it!

Hi, I suggest you to contact some good lawyers to evaluate your qualifications for NIW. They can do that for free. For example, www.murthy.com. Also, it's not a good idea to post your question under this topic (about employer letter). Many other people who may give you suggestions may not see your posting at all because of the title of the topic. I suggest you start a new thread with a subject something like "Please evaluate my qualifications for NIW". But all in all, a better way is to get free evaluations from several good lawyers.
